California Legislature Passes Bill to Protect Transgender Healthcare

California lawmakers have sent a fresh bill to Governor Gavin Newsom’s desk that would again strengthen legal protections for transgender healthcare, setting the stage for a high-profile showdown over access to gender-affirming care as federal policy moves in the opposite direction.

For Californians who don’t wish to invest their hard-earned cash in covering the cost of treatment that they find ethically objectionable, the Senate Bill 497, authored by radical progressive Senator Scott Wiener, is another warning of what may be on the horizon from their health insurance providers.

The controversial bill passed the Assembly 56-14 and the Senate 30-10, reflecting strong support among California Democrats for transgender rights. The bill aims to reinforce the state’s commitment to ensuring access to gender-affirming care, even as the Trump administration’s new rules, finalized in June 2025, will soon prohibit Affordable Care Act (ACA) Marketplace plans from covering such care as an Essential Health Benefit starting in 2026.

The federal changes mean insurers will no longer be required to include gender-affirming services—such as hormone therapy and surgeries—in standard plans, and any remaining coverage could lose key consumer protections.

Critics of these procedures, including some in the medical field, argue they are costly, experimental, and should not be subsidized by taxpayers or policyholders who object on ethical or religious grounds. Supporters, however, say these treatments are necessary for transgender individuals.

California’s new bill is designed to counteract the federal rollback by mandating that state-regulated insurance plans continue to cover gender-affirming care. The legislation also includes provisions to shield patients and providers from out-of-state legal action and data requests, a response to increasing efforts in other states to restrict or penalize such care.

While a clear majority of Americans state that they do not want to see federal funding for such treatment, which includes sex-change operations and hormone drugs, Wiener used inflammatory rhetoric to re-affirm his commitment to the trans agenda.

“The Trump Administration is trying to make transgender people the scapegoats for their fascist takeover, and California must stand up to protect them,” said Senator Wiener in a statement.

“President Trump has made it clear he is willing to violate laws and norms to target transgender people, and that he will not stop until their existence has been erased from public life. California must do everything in our power to protect the transgender community, and I’m confident that the Governor will continue his longstanding leadership on trans issues.”

Opponents argue that every new mandate drives up insurance premiums for all Californians, with insurers already proposing an 18% median premium increase for 2026, citing coverage mandates as a key driver. They warn that the cost of maintaining these protections could fall on state taxpayers if federal funding is withdrawn.

Governor Newsom has not indicated whether he will sign the bill, but advocates and opponents alike are watching closely.
